| 1. Marriage to a Japanese National | 1. 日本人との結婚 |

| When marrying a Japanese national in Japan, there is a need to submit notification to the public office in your local municipality. The following are items you must submit when applying: | 日本で日本人と結婚する場合、市区町村役場に届け出なければいけません。以下の書類が必要です。 |

1. Certificate of Alien Registration 2. Passport 3. Certification of competency to marry (Konin Yoken Gubi Shomeisho) from your embassy or consulate. (Those documents not in Japanese must be accompanied with a Japanese translation with the name and address of the individual who has translated it.) 4. Notification of Marriage (These are available at the local public office. In order to register your marriage, you must have the signatures/seals of two witnesses who are 20 years of age or older. In addition, the notification must be written in Japanese.) 5. Copy or Abstract of your partner's (Japanese national) family register (Refer to the list as to where this can be obtained.) |

| A marriage is valid from the day it is registered. Please note that once married, differences may surface with respect to taxes, pension, health insurance and job allowances. | It is possible, according to determined conditions, for two non-Japanese to marry under Japanese law. However, do note that the marriage may not be valid in the respective native country or countries in the future. Registration should be carried out at the respective embassy or consulate and the public office in your local municipality. | Legal procedures concerning divorce ininternational marriages can becomecomplicated. Even though divorce isrecognized according to the procedurestaken in Japan, please note that it may beinvalid in your native country. Thus, wewill stick to a general explanation here andrecommend that you consult an individualknowledgeable in the area such as aforeign consultant or specialist. | 国際結婚の場合の離婚手続きは法律関係が複雑な場合があります。日本の手続きで離婚が認められても、あなたの本国では無効となる場合があるなど注意が必要です。ですからここでは一般的な説明にとどめ、実際には外国人相談や専門家など詳しい人に相談されることをお勧めします。 |
| 2. When You Don't Consent to Divorce | 2. 離婚したくないとき |
| There is a system of divorce by mutualconsent in Japan by which the notificationof divorce is submitted and accepted andstands based on the agreement by both thewife and husband. When you as a foreignnational are pressed for a divorce by aJapanese national that you don't want,submission of a signed notification can result in a standing divorce. However, inorder to prevent this you should submit arequest not to accept the divorcenotification to the public office in whichthe family register of your Japanese spouseis held. However, the validity of thisrequest lasts only six months and anythingover this period will require an extension.If you don't divorce through mutualconsent, in this manner you will not bedivorced by your spouse without a mediate or proper legal procedure. However, thissystem cannot be utilized if both wife andhusband are non-Japanese. | 日本には協議離婚という制度があります。これは夫婦が合意のうえ離婚届を市町村長に提出し、受理されることにより成立します。あなたが外国籍で日本人の配偶者から望まぬ離婚を迫られている場合、離婚届に署名し届出が提出されれば離婚が成立することがあります。それを防ぐためには日本人配偶者の本籍地の役所に離婚届の不受理申請を提出しておくとよいでしょう。ただし6カ月で効力がなくなるので申請を更新しておく必要があります。このようにしてあなたが協議離婚に応じない限り、調停や裁判手続きなしに一方的に離婚されることはありません。ただしこの制度は、夫婦とも外国人の場合は適用されません。 |

| When both wife and husband are non-Japanese, the status of the divorce will depend on the laws of their respective native country or countries. In such cases, you are advised to inquire upon such matters at the respective consulates in Japan. If either the wife or husband is a Japanese national residing in Japan and both have agreed to divorce under Japanese law, the divorce will stand according to Japanese law. Inquire at your respective municipality's public office for details | 夫婦とも外国人の場合、離婚は本国の法律によりますので、ぞれぞれの本国の在日大使館か領事館に問い合わせて下さい。夫婦のどちらかが日本に居住する日本人で両方が日本の法律により離婚する旨同意すれば、日本の法律により離婚することになります。詳しくは市町村に問い合わせて下さい。 |

| If you are residing in Japan with the status of Spouse or Child of a Japanese National, you may lose that status once divorced. Also, the same may be said for any non-Japanese who is married to another non-Japanese and residing in Japan with the status of Dependent. In both cases, not changing the status can result in your not being able to reside in Japan. Thus, for such cases it is recommended that you inquire at locations offering consultation at public offices or the Alien Residency Comprehensive Information Center, Osaka | あなたが日本人の配偶者としての在留資格で滞在している場合、離婚するとその資格を失うこともあります。また外国人同士の結婚で家族滞在の資格で滞在している場合も同様の問題が生じる恐れがあります。いずれも資格の変更がないと日本に滞在できないことがありますので、各種相談窓口や外国人在留総合インフォメーションセンターで問い合わせて下さい。 |
